The Eviction Process in Texas

Notice to Vacate
When a tenant falls behind on rent or violates lease terms, we serve a formal 3-day Notice to Vacate as required by Texas Property Code. This notice is delivered in person or posted on the door and mailed via certified mail.
Eviction Suit Filed
If the tenant fails to comply with the notice, we file an eviction suit (forcible detainer) at the Justice of the Peace court in the precinct where the property is located. Filing includes all required documentation and proper service of citation.
Court Hearing
The court hearing is scheduled within 10-21 days of filing. We coordinate with our eviction attorney to represent your interests. If the tenant fails to appear, a default judgment is typically entered in the landlord's favor.
Judgment & Writ of Possession
After a favorable judgment, we request a Writ of Possession if the tenant has not vacated. The constable posts a 24-hour notice, then supervises the lockout. We coordinate the entire process and secure the property afterward.
